Inclusion of nicotine pouches in UK tobacco-free generation legislation

The United Kingdom is further strengthening its public health legislation by including nicotine pouches in its bill aimed at creating a tobacco-free generation. This decision is part of a firm response to growing concerns about the rise of nicotine products popular with young people, which have previously been poorly regulated. The government aims to limit their accessibility, prevent the risks of addiction, and strengthen the coherence of its policies to combat smoking and vaping.[1].
Nicotine pouches affected by new legislation
The UK government has confirmed that nicotine pouches, sometimes incorrectly called "snus" even though they do not contain tobacco, will be included in its Tobacco Free Generation legislation.[2]These products, designed to deliver nicotine orally when placed between the lip and gum, are now subject to restrictions similar to those governing tobacco products. The announcement comes after controversy over free distribution campaigns in public spaces, notably at Edinburgh's Waverley Station, which provoked outrage from several Scottish elected officials. Public Health Minister Jenni Minto clarified that the bill currently under debate also covers heated tobacco products and nicotine pouches, in order to curb their use among younger people. Traditional snus, which contains tobacco, remains banned in the United Kingdom and throughout the European Union except Sweden, but tobacco-free alternatives are experiencing a worrying boom. Public health experts have highlighted their addictive potential and the risks to oral health. They welcome the extension of this legislation to products previously outside the regulatory framework.
A bill for a tobacco-free generation
THE " Tobacco and Vapes Bill ", presented as a major reform, aims to gradually introduce a ban on the sale of tobacco products to people born on or after January 1, 2009, thus legally preventing the sale of these products to any future generation. It also intends to more strictly regulate all nicotine products, including e-cigarettes with or without nicotine and nicotine pouches. The law will give the government new leverage to restrict the marketing of these products, particularly in terms of flavors, packaging, signage, and advertising. The text also includes measures to extend restrictions related to smoking in public spaces, particularly around schools. This project is part of a comprehensive prevention strategy, in response to the worrying increase in vaping among young people and the diversification of nicotine products made available to them.
High-strength nicotine pouch alert
Alongside the legislative discussions, British health authorities recently issued a warning about the growing presence of very high concentration nicotine pouches, sometimes up to 150 mg per unit.[3]Presented in colorful and often flavored packaging, these products are widely distributed via the Internet and in stores, sometimes without effective age control. Several cases of poisoning and hospitalization have been reported, particularly among adolescents who have consumed several of these products or by mistake. A survey conducted among 2,100 young people aged 15 to 18 revealed that nearly half of them identified nicotine pouches as a very common product among their peers, just after e-cigarettes. Faced with this proliferation, the authorities have stepped up controls and seized more than 12,000 non-compliant pouches since 2023. The integration of these products into the new law thus aims to compensate for the lack of a strict regulatory framework and to better protect young people against the harmful effects of early exposure to nicotine.
